Jessica L. Toelstedt

Jessica joined Mason Law & Mediation, LLC as a partner in 2025 and has been practicing family and matrimonial law for nearly twenty years. Prior to joining MLM, Jessica was a partner at Berkman Bottger Newman & Schein, LLP, where she was Co-Chair of the Mediation and Collaborative Law Practice.

After spending the first half of her career litigating matrimonial matters, Jessica has spent the last decade focused on helping her clients resolve family law matters outside of court. As a teenager, Jessica experienced firsthand the challenges of her parents’ divorce and of a parent’s history with drug and alcohol abuse. It is that personal experience, together with her experience as a young attorney in litigation, that fuel Jessica’s desire to help her clients navigate family law issues in a healthier way. Jessica deeply values the opportunity to work with individuals and couples at a critical time in their lives, and to make a meaningful difference for her clients and their families.

Jessica’s reputation for the highest ethical standards and professional ability has earned her numerous awards, including a peer rating of AV Preeminent from Martindale-Hubbell and selection to Super Lawyers’ New York Super Lawyers and Rising Stars lists for over a decade.

Jessica was trained in mediation by the Center for Understanding in Conflict and in Collaborative Law by the New York Association of Collaborative Law Professionals. She serves as Vice President of the Board of Directors for the Family and Divorce Mediation Council of Greater New York.

Jessica resides on Long Island with her husband, two children and their yellow lab, Penny.

Q&A: Get to Know Jessica

Q: Where’d you grow up? 

A: I grew up in a suburb of Buffalo until my parents divorced, and my mother remarried. From age 13 through high school, I lived in a very rural area, about 45 minutes from Buffalo. We joked growing up that there were more cows than people. 

Q: What do you do outside of work?

A: I spend time with my husband, children (boy/girl twins – age 8) and dog, Penny. I also love to exercise. Some of my favorites are Peloton, F45, hot yoga and running.

Q: Favorite trip? 

A: Each year, we take our kids skiing upstate. Those trips are my favorite, both because we get to spend the days outside in the fresh air, but also because of the quality family time we have at the end of the day, playing board games and sitting by a fire together. 

Q: Random fact about you?

A: I know how to preserve food using the water bath canning process. I make all sorts of pickles, jams, and mustard, but my favorite recipe is called “Cowboy Candy.” It is made with fresh jalapeños canned in a sweet brine that you can use in dip, on tacos, or really anything! 

Q: Favorite food? 

A: It’s a toss-up between steak and not surprisingly, since I’m originally from Buffalo – chicken wings and blue cheese. Don’t get me started on those that dip in ranch!

Q: Married? 

A: Yes, with boy/girl twins and a yellow lab, Penny. 

Q: Favorite part of your work? 

A: Being able to give sound advice to my clients. As a trusted confidante, one of the greatest benefits I can give is in being an objective third party. It is also incredibly rewarding to help parties transition from one part of their lives to something new. I am so grateful that people put their lives and the lives of their children in my hands, and I do not take that role lightly.
